Where a jury returned a verdict holding the commonwealth liable to a plaintiff who lost an eye when he was struck by a criminal convict while the plaintiff was civilly committed (on the petition of his wife) for alcoholism, the verdict was not precluded by any of the immunity provisions of the Massachusetts Tort Claims Act.
