Negligence – Medical malpractice

Where the defendant doctor released a patient with a prescription of Ativan and, the day after discharge, the patient was hit by a train and died, dismissal of the plaintiff’s medical malpractice claims was improper, as (1) the plaintiff produced sufficient evidence that the defendant’s treatment fell below the standard of care and (2) there was an adequate causal relationship between the defendant’s alleged negligence and the harm that occurred.
