Insurance – PIP – Jurisdiction

Where a physical therapist has moved to dismiss an insurance company’s complaint, a dismissal is not warranted despite (1) the physical therapist’s assertion that the amount in controversy is less than the minimum required for Superior Court jurisdiction and (2) the pendency of a District Court suit involving the same subject matter.
